Can a non-veteran assume a VA loan?

By the AssumptionHub team · Last updated

Yes. A VA loan can be assumed by anyone, veteran or not, as long as the buyer meets the loan servicer's credit and income requirements and the servicer approves the assumption. The buyer takes over the existing balance, interest rate and remaining term.

The catch is for the seller: when a non-veteran assumes the loan, the veteran's entitlement stays tied to that loan until it's paid off. A veteran buyer can substitute their own entitlement to free it up.

Who can assume a VA loan

The VA doesn't require the person assuming the loan to be a veteran. The buyer has to:

What it costs

What happens to the seller's VA entitlement

Entitlement is the VA guaranty a veteran uses to borrow with no down payment. If a non-veteran assumes the loan, the seller's entitlement for that loan stays in use until the loan is paid off. The seller keeps any remaining entitlement and can still buy again with a VA loan. That remaining amount grows when county loan limits rise. Our VA entitlement page shows how.

If a veteran buyer assumes the loan and agrees to substitute their entitlement, the seller's entitlement is restored in full.

Release of liability

In a formal assumption approved by the servicer, the seller should also get a release of liability, which means they're no longer responsible if the buyer stops paying. Make sure the release is part of the approval. "Subject-to" deals, where the buyer takes over payments without the servicer's approval, don't release the seller and can trigger the loan's due-on-sale terms.

Frequently asked questions

Do you have to be a veteran to assume a VA loan?

No. Any buyer who meets the servicer's credit and income requirements can assume a VA loan.

Does a non-veteran pay the VA funding fee on an assumption?

Yes. The VA funding fee for an assumption is 0.5% of the loan balance. Buyers who are exempt from the funding fee, such as veterans receiving VA disability compensation, don't pay it.

Does the veteran lose their entitlement if a non-veteran assumes their loan?

The entitlement used on that loan stays tied to it until the loan is paid off, unless a veteran buyer substitutes their own entitlement. The seller keeps any remaining entitlement and can still use it to buy another home.

Is the seller released from liability in a VA assumption?

They should be, if the assumption is formally approved by the servicer and the release of liability is included. A subject-to transaction does not release the seller.
